OpenAI has publicly endorsed a California legislative proposal, identified as Assembly Bill 3211, which mandates that technology companies label content generated by artificial intelligence (AI). This support was articulated in a communication from OpenAI’s Chief Strategy Officer, which was obtained by Reuters. The bill is currently scheduled for a decisive vote in August.
Assembly Bill 3211 stipulates the inclusion of watermarks within the metadata of AI-generated media, such as photographs, videos, and audio recordings. While many AI firms have already adopted metadata labeling practices, it is noteworthy that a significant portion of the public does not typically engage with metadata. To address this issue, the bill also intends to require major online platforms, including Instagram and X, to clearly label AI-generated content in a manner that is easily comprehensible to the general audience.
In a contradicting stance, a trade association representing OpenAI’s principal investor, Microsoft, along with other software firms, expressed opposition to Assembly Bill 3211 in April, characterizing the legislation as “unworkable” and “overly burdensome” in a letter addressed to California lawmakers.
This recent endorsement by OpenAI follows a decision to oppose Senate Bill 1047, another California initiative that has garnered significant criticism. Nonetheless, it is important to highlight that OpenAI has shown support for various federal measures intended to regulate AI companies more comprehensively.
